for the provision of massage services and sale of goods

1. General provisions

1.1. Individual entrepreneur (sole proprietor under Ukrainian law) Hanna Karamavrova, taxpayer ID: 3266511405, business address: Ukraine, 08205, Kyiv region, Irpin, Universytetska street 3/3, not a VAT payer, hereinafter referred to as the "Provider", offers any adult individual, hereinafter referred to as the "Client", to enter into this Public Agreement.

1.2. This document is a public offer in accordance with Articles 633 and 641 of the Civil Code of Ukraine.

1.3. Any of the following actions shall be deemed acceptance of this offer:

1.4. This Agreement is open-ended and remains in force until it is revoked by the Provider.

1.5. The Provider may amend this Agreement unilaterally. Changes take effect from the moment they are published on the website. Further use of the services is deemed confirmation of the Client's consent to the updated version.

2. Subject of the Agreement

2.1. The Provider provides massage services.

2.2. Massage is not a medical service, is not a treatment, and does not replace consultation or treatment by a doctor.

3.1. Services are not provided in the presence of contraindications, in particular:

3.2. In case of pregnancy, the Client confirms that they have a doctor's approval for massage sessions. The fact of booking and receiving the service confirms such approval.

3.3. The Client undertakes to provide accurate information about their state of health.

3.4. The Provider shall not be liable for possible consequences if the Client has concealed their health condition or failed to disclose relevant information about it.

4. Booking, cancellation, and lateness

4.1. If an appointment is cancelled or rescheduled less than 2 hours before the visit, the next appointment is possible only with full prepayment.

4.2. If a prepaid appointment is cancelled or rescheduled less than 2 hours before the visit, the funds are non-refundable.

4.3. Lateness:

4.4. In case of an air raid alert, the session may be stopped at the Client's request and rescheduled without loss of funds.

5. Payment

5.1. Payment can be made by:

5.2. A fiscal receipt is provided to the Client in accordance with Ukrainian law.

5.3. Funds paid for a service are non-refundable and are credited to the Client's balance for further use.

6. Memberships

6.1. The validity period of a membership is specified at the time of purchase.

6.2. The validity period of a membership is calculated from the moment of activation.

6.3. Membership activation takes place on the day of the first visit, or automatically 30 days after the purchase date.

6.4. A membership can be given as a gift but may be used by one person only.

6.5. Funds for a membership are non-refundable.

7. Gift certificates

7.1. The validity period of a certificate is specified at the time of purchase.

7.2. The validity period of a certificate starts from the day following the purchase date.

7.3. Unused funds remain on the Client's balance and may be used later.

7.4. Funds for a certificate are non-refundable.

8. Sale of goods

8.1. Return of goods of proper quality is possible within 14 calendar days from the date of purchase, provided that:

9. Rules of conduct

9.1. By booking or paying for a service, the Client confirms that they are a fully capable person who has reached 18 years of age, understands the meaning of their actions, and can control them. If in doubt, the Provider may request presentation of an identity document (including in Diia).

9.2. The Client must observe ethical norms of behavior.

9.3. The Provider has the right to refuse services in case of:

Consequences of violating the rules: if the Provider refuses to provide Services or terminates a Service on the grounds set out in clauses 9.2 and 9.3 of this Agreement (intoxication, inadequate behavior, concealment of contraindications), the Service is deemed not provided due to the Client's fault. In such case, funds paid for that session (or for reserved time) are non-refundable.

9.5. The Provider is not responsible for safekeeping of the Client's personal (valuable) belongings left unattended in treatment rooms or common areas. The Client is solely responsible for protecting and preserving their property while on the premises.

9.6. The Client bears financial responsibility for damage to the Provider's property or equipment caused by the Client's actions.

10. Photo and video

10.1. Photo and video recording of the Client for use in marketing materials (website, social media, etc.) is carried out only with the Client's prior consent. Use (publication) of such materials is allowed only with separate consent of the Client.

10.2. Video surveillance may be carried out on the Provider's premises for safety purposes. Video surveillance is conducted only in common areas and is not conducted in treatment rooms, shower rooms, or restrooms. By being present on the premises the Client acknowledges the existence of video surveillance.

11. Personal data

11.1. The Client provides personal data (full name, phone number, etc.) and health information (contraindications, allergies, etc.) by completing the first-visit questionnaire. By completing and signing such questionnaire, the Client gives the Provider clear consent to collect, process, and store this data in the Provider's CRM system.

11.2. The Client has the right at any time to withdraw consent to data processing or request deletion of their data by sending a message to the Provider's contact details.

12. Liability of the Parties

12.1. If the Provider's liability is established, the amount of such liability is limited to the cost of the service actually provided.

12.2. Current prices are posted on the premises, on the website, or in official communication channels.

12.3. The Provider has the right to change prices unilaterally without retroactive effect on already paid services.
